I, Shelby B. Nofsinger, and I, Minnie B. Nofsinger, and each of us being of sound mind and memory, do hereby make, publish and declare this to be our Last Will and Testament, hereby revoking any and all wills heretofore made by us or either of us.

ITEM I It is the Will of each of us and both of us that all debts and funeral expenses be paid.

ITEM II We give, devise, and bequeath unto the survivor of us, all and any real and personal property, either owned by us jointly or severally, absolutely and in fee simple title.

ITEM III On the death of the survivor of us, all the real and personal property, which such survivor shall die seized and possessed of, is given, devised and bequeathed by us and by such survivor to the following persons, to-wit: Oscar D. Nofsinger, Brendice McCandless, Halbert N. Nofsinger, children of testator, Shelby B. Nofsinger, by a previous marriage, and Wallace D. Nofsinger, Mendel L. Nofsinger, and Carolyn Haack, children of our marriage, share and share alike in fee simple, provided, however, that if any of the named legatees predeceasing us, leave issue surviving us, such issue shall take in equal parts per stirpes, the share of which such predeceasing legatee would have taken had it survived.

ITEM IV This Will is not executed by us in performance of any contract and either of us shall be free to revoke this Will in whole or in part, and if he or she wishes to do so, to execute a new Will, either before or after the death of the other, which shall contain such provisions as he or she may wish.

ITEM V We hereby nominate, constitute, and appoint the survivor of us, executor or executrix as the case may be, of this our mutual and joint Will and Testament to serve without bond. In the event both of us die in a common disaster, or one dies, and the survivor shall fail to qualify as executor or exectrix hereunder, or shall qualify and serve, but then cease to serve for any reason whatsoever, then we nominate, constitute, and appoint Wallce D. Nofsinger to be Executor of this Last Will and Testament.

IN WITNESS WHEREOF, we have hereunto set our hands and seal to this our Last Will and Testament at the City of Central City, State of Kentucky, this the 31 day of August, 1971.

The foregoing instrument was signed by Shelby B. Nofsinger and wife, Minnie B. Nofsinger, and by them ackowledged to be their Last Will and Testament in our presence, sight and hearing, who at their request have hereunto subscribed our names as witnesses in their presence and in the presence of each other, at Central City, Muhlenberg County, Kentucky, this the 31 day of August, 1971.

Nofsinger, deceased, and ordered of record as such.
